California Governor Grants Clemency to 548 Death Row Inmates, Paving the Way for Presidential Run

In an open letter addressed to all Californians on the 5th, California Governor Gavin Newsom announced that, guided by his personal moral convictions, he will exercise the constitutional clemency powers granted to the governor to commute the death sentences of 548 inmates to life in prison without the possibility of parole. This marks the largest mass commutation of death row inmates in U.S. history. However, because 382 of these cases involve more than one prior felony, they require case-by-case review and approval by the Supreme Court of California before the commutations can take effect—sparking debate over whether this action defies the will of voters and judicial rulings.
California has not carried out an execution in nearly two decades, with the last one taking place in 2006 under Republican Governor Arnold Schwarzenegger. Newsom officially instituted an execution moratorium shortly after taking office in 2019, stating at the time that he could not bear the risk of an innocent person losing their life due to a wrongful conviction. His recent shift from a moratorium to sweeping commutations has drawn widespread scrutiny.
The move has drawn sharply polarized reactions. Supporters emphasize the risks of wrongful convictions and systemic racial disparities inherent in capital punishment, whereas opponents argue that wholesale commutations run counter to the electorate’s repeatedly expressed intent to retain the death penalty and inflict secondary trauma on victims' families. Because the death penalty itself has not been abolished, courts can still sentence defendants convicted of capital crimes to death, and future incoming governors could resume executions.
Newsom will step down from the governorship in 2027 and is widely anticipated to run in the 2028 presidential race. Commentators and online observers suggest that he may be looking to solidify his Democratic base through these commutations, building political capital for a prospective 2028 presidential campaign. Should Newsom seek the presidency, the debate surrounding the abolition of the death penalty sparked by these commutations is poised to escalate from a state-level dispute into a central battleground of the nationwide election.
